These Terms of Use (“Terms”) govern your use of the AC InvoicePro application (“App”). The App is developed and maintained by Alexander J. Stoneham (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to these Terms.
1. Distribution & Licensing
The App is distributed exclusively via the Mac App Store. Your license to use the App is granted through your valid purchase or download using your Apple ID, and is subject to Apple’s applicable terms and license rules. You must comply with the Mac App Store terms at all times.
2. Permitted Use
- You are granted a personal, non-transferable, non-exclusive license to install and use the App on macOS devices associated with your Apple ID in accordance with Apple’s licensing rules (including Family Sharing, if applicable).
- You may use the App for creating and managing invoices and related business documents.
- You are responsible for complying with all laws and regulations applicable to your use of the App and the documents you create.
3. Prohibited Use
- No reverse engineering, decompiling, disassembling, or attempting to derive the source code of the App, except to the extent permitted by applicable law.
- No renting, leasing, sublicensing, reselling, or making the App available to third parties beyond Apple’s rules.
- No use that interferes with, disrupts, or harms the App, its services, or other users.
- No use that violates intellectual property rights, privacy, or applicable laws.
4. Ownership & Intellectual Property
The App and all related materials are owned by or licensed to Alexander J. Stoneham and are protected by copyright and other intellectual property laws. These Terms do not transfer to you any ownership rights in the App.
5. App Store Purchase, Billing & Refunds
Purchases, billing, taxes, and refunds are handled by Apple as the merchant of record. Any refund requests must be submitted through Apple’s Report a Problem or other official Apple channels. We do not process payments or refunds directly for Mac App Store transactions.
6. Updates & Changes
We may provide updates, bug fixes, or improvements through the Mac App Store. Some updates may be required to continue using the App. Features may change, and we may discontinue or modify parts of the App at our discretion.
7. Data & Privacy
Our handling of personal information is described in our Privacy Policy. The App may store data locally on your device. You are responsible for backing up your data. We are not responsible for loss or corruption of your data, whether due to device failure, user error, or other causes.
8. System Requirements & Availability
The App requires a compatible macOS device and may rely on certain system permissions and internet connectivity for some functions. Performance and availability can vary with your device, OS version, and network conditions.
9. Third-Party Services
The App may interoperate with third-party services (for example, OS-level frameworks, email clients, or cloud storage you choose to use). Your use of third-party services is governed by their terms, not ours. We are not responsible for third-party services.
10. Warranty Disclaimer
To the maximum extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to lost profits, lost data, business interruption, or other commercial damages or losses, arising out of or related to your use of or inability to use the App, however caused, regardless of the theory of liability (contract, tort, or otherwise), even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold harmless Alexander J. Stoneham from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the App or violation of these Terms.
13. Termination
These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically without notice from us if you fail to comply with any term(s). Upon termination, you must cease all use of the App and delete all copies.
14. Export & Sanctions Compliance
You must comply with all applicable export control and sanctions laws. You represent that you are not located in a restricted country and are not on any government list of prohibited or restricted parties.
15. Apple as Third-Party Beneficiary
Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary, to the extent they relate to your licensed use of the App on Apple-branded devices and through the Mac App Store.
16. Governing Law
These Terms are governed by the laws applicable in your place of residence or, if required by local law, by the laws of the jurisdiction where you purchased the App via the Mac App Store, without regard to conflict-of-laws principles. You and we submit to the non-exclusive jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the “Effective date” above. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
